Today I arrived an hour early to watch the Olympic torch pass by the office (this is the picture I took, facing our office, as the torch passed by).&lt;br /&gt;&lt;br /&gt;There was a light dusting of snow on the ground, and it was still dark (the shortest day of the year was yesterday) as I stood across the street waiting for the festivities to begin.  I already knew what to expect; my two boys wanted to see the torch, so my boys, my wife and I braved the chill last night to stand on Colborne Street waiting for the torch.  Last night I could see a few hundred people lining Colborne Street.  This morning at 7:00 am there were a few dozen people on Brant Avenue, also braving the cold.&lt;br /&gt;&lt;br /&gt;The torch was cool, but what struck me where the literally dozens of vehicles that accompanied the torch runner.  There were Brantford police, OPP and RCMP vehicles, and city of Brantford trucks.  There were security people on bicycles.  There were trucks with singers and dancers, and this is where my financial mind took over: how much is this costing us?&lt;br /&gt;&lt;br /&gt;According to the &lt;a href="http://www.vancouver2010.com/more-2010-information/olympic-torch-relay/torch-relay-faqs/"&gt;official torch relay web site&lt;/a&gt; "The 2010 Olympic Torch Relay is self-funded and revenue comes from sponsorships and contributions."  I have a hard time believing that the Brantford Police, the OPP and the RCMP are "self-funded" from "sponsorships and contributions".&lt;br /&gt;&lt;br /&gt;There is no "free lunch".  If something seems too good to be true, it probably is.  Just because the store says you don't have to pay for a year, doesn't mean you never have to pay.  A zero percent interest deal doesn't mean there is no interest; it just means the interest costs are built into the cost of the product.  And just because they tell us that the Olympic Torch Relay is "self-funded" doesn't mean that we as taxpayers aren't footing at least some of the bill.&lt;br /&gt;&lt;br /&gt;I'm not a total cynic.  I like the Olympics, and I hope our athletes do well.  But the thought did occur to me this morning that instead of standing in the dark watching a parade of corporate sponsored trucks, perhaps I personally would have been better off putting on my own running shoes and going for a run.&lt;br /&gt;&lt;br /&gt;That's my message today: look out for yourself, and don't buy into the corporate hype.  Buying that fancy new gizmo probably just means you will end up paying more in interest for something you don't really need.  If the corporations want to spend millions of dollars on the Olympics, that's their prerogative. Their office is at 54 Brant Avenue, which is about a five minute walk down Brant Avenue here in Brantford from our office at 218 Brant Avenue.  They are a not-for-profit agency that specializes in helping residents of Brantford find solutions to their financial problems.  They can often work out a debt management plan where you repay your debts over a period of time, with a reduced interest rate, so you can avoid bankruptcy.&lt;br /&gt;&lt;br /&gt;We discussed some of the &lt;a href="http://www.hoyes.com/new-bankruptcy-law-canada.htm"&gt;new bankruptcy rules&lt;/a&gt; that came into force on September 18, 2009.  Some of the new rules are complicated, and I was impressed by their knowledge of the implications of many of the new rules.  They truly want to find the best solution for their clients, and to do that they take the time to explain all of the options.&lt;br /&gt;&lt;br /&gt;(As an aside, there are some "for profit" debt consultants who pretend they are acting in your best interests, but often they will charge you a fee and NOT explain all of your options.  At the Family Counselling Centre of Brant, and here at my firm, Hoyes, Michalos &amp;amp; Associates Inc., we explain all options so that you can make an informed decision).&lt;br /&gt;&lt;br /&gt;They told me that there are a lot of people in Brantford having financial problems, and I agree; we are also very busy. When we were married we signed up with Direct to home grocers where they send you a years worth of groceries and pay $400/mo. My husband has stopped paying for the monthly payment. He is the applicant and I am the co-applicant. He had talked about &lt;a href="http://www.bankruptcy-canada.ca/"&gt;going bankrupt&lt;/a&gt; but hasn't. Doesn't the creditor go after the applicant first and only after the co-applicant if the applicant goes bankrupt??? Let me know.&lt;br /&gt;&lt;br /&gt;&lt;span style="font-weight: bold;"&gt;Answer&lt;/span&gt;: In general, yes, the creditor will pursue the applicant first.  If the applicant does not pay, then the creditor may pursue the co-applicant. The article, part of their series on Tough Times, discussed the &lt;a href="http://www.brantford.com/index.cfm?page=home&amp;amp;section=News&amp;amp;id=1777"&gt;record rate of increase in personal bankruptcies in Brantford&lt;/a&gt;. Since we opened our Brantford bankruptcy office in 1999, we have never had a busier month than we just finished. In fact, our volume in June, 2009 was more than twice as high as it was in June, 2008. The bad news for Brantford residents is that June is not normally a busy month; we are usually busy in March, April and May, and then as the summer approaches we slow down. Not this year. Our Brantford help line is busier than ever, with no slow down in sight.&lt;br /&gt;&lt;p&gt;Why is this happening?&lt;/p&gt;&lt;p&gt;First, more people in Brantford are losing their jobs, or having their hours reduced at work, so they just can't make ends meet.&lt;/p&gt;&lt;p&gt;Second, house prices continue to fall in Brantford, so it's no longer possible to re-finance your house to pay off your debts, or sell your house at a profit to raise cash. An increasing number of Brantford residents are finding themselves "under water" (the value of their house is less than the amount owing on the mortgage), so they are letting the bank foreclose, and they are finding a place to rent, and then dealing with the resulting shortfall. &lt;/p&gt;&lt;p&gt;Finally, a large number of the people I meet are no longer optimistic. They believe that the recession won't end tomorrow, so they are deciding to go bankrupt now to deal with their debts, in the hope that by 2010 the economy has improved, and they will have a fresh start.    &lt;/p&gt;&lt;p&gt;I can't predict when the recession will end, or when house prices in Brantford will start to increase, but I can tell you that debt problems don't go away on their own, so if you are struggling with debt, now is the time to act. The answer: I don't.  I don't see gambling debts as a problem any more than I would see in any of my firm's other &lt;a href="http://www.hoyes.com/bankruptcy-offices-ontario-directions.htm"&gt;Ontario bankruptcy offices&lt;/a&gt;.&lt;br /&gt;&lt;br /&gt;However, I do have a large number of Brantford residents that have filed a bankruptcy or consumer proposal with me that &lt;span style="font-weight: bold;"&gt;work at the casino&lt;/span&gt;.  The casino is one of the largest employers in Brantford, so it's not that surprising that I meet with people who work there.  Often they lose their job, are off work for a period of time, and then they finally get a job at the casino, and they are afraid that their wages may be garnisheed, so they file bankruptcy.  Their financial problems are not caused by gambling at the casino.&lt;br /&gt;&lt;br /&gt;This morning I met with two people who are currently in the bankruptcy process with me, and both of them work at the casino.  I asked them how business was, and they both said the same thing:&lt;br /&gt;&lt;br /&gt;Booming.&lt;br /&gt;&lt;br /&gt;That surprised me; I would have assumed that during a recession people would save their money and gamble less, but apparently that's not the case.  The casino is very busy these days.&lt;br /&gt;&lt;br /&gt;I asked both people why they thought the casino was busy during a recession, and they both had the same response: If you have lost your job, and if you have very little money, you are looking for &lt;span style="font-weight: bold;"&gt;hope&lt;/span&gt;.  The casino offers hope.  They hope that they may win some money and make everything better.&lt;br /&gt;&lt;br /&gt;I have no objection to people going to a casino.  It's your money, you can spend it as you wish.  I don't see much difference between spending $100 at the casino, or spending $100 on dinner and movie, or $100 going to a sporting event.&lt;br /&gt;&lt;br /&gt;I do worry about people spending money they don't have, and my two contacts this morning told me that they worry about that as well.  If you are spending your Employment Insurance or Welfare cheque at the casino, you've got a problem.  We all want hope, but that's not a good way to get it.&lt;br /&gt;&lt;br /&gt;Here's my advice: if you are down on your luck, don't despair.  We are in the worst recession any of us have ever lived through.  You are not alone.  Everyone else is also worried about losing their job, or not having enough money to pay the bills.  Instead of hoping to win by gambling, a better strategy is to follow my three point plan for financial success:&lt;br /&gt;&lt;br /&gt;1. Make a budget.  Unless you know where your money is going, you can't control it.  Here's a link to some &lt;a href="http://www.moneyproblems.ca/household-budgeting.htm"&gt;free personal budgeting tools&lt;/a&gt;.&lt;br /&gt;&lt;br /&gt;2. Pay off debt.  A recession is not the time to be carrying a lot of debt, so pay down your debts as fast as possible.  If you have more debt than you can handle, it's time to &lt;a href="http://www.hoyes.com/bankruptcy-alternatives.htm"&gt;investigate your options&lt;/a&gt;.&lt;br /&gt;&lt;br /&gt;3. Once your debt is under control, start saving money.  It's a lot easier to survive a job loss if you have money in the bank.&lt;br /&gt;&lt;br /&gt;There is hope, but in most cases the casino isn't the solution.  It's fine as entertainment; gambling is not a financial plan. The &lt;a href="http://www.ic.gc.ca/eic/site/bsf-osb.nsf/eng/h_br01011.html"&gt;Office of the Superintendent of Bankruptcy&lt;/a&gt; released statistics this morning showing that personal bankruptcies are on the rise in Brantford.&lt;br /&gt;&lt;br /&gt;In the first three months of 2009 there were 125 residents of Brantford that filed &lt;a href="http://www.bankruptcy-canada.ca/bankruptcy/"&gt;bankruptcy&lt;/a&gt;, and a further 47 people filed a &lt;a href="http://www.hoyes.com/consumer-proposals.htm"&gt;consumer proposal&lt;/a&gt;.  That's a total of 172 filings, as compared to 124 filings during the same period last year.&lt;br /&gt;&lt;br /&gt;That means that personal insolvencies in Brantford increased by 38.7% in the first three months of this year.&lt;br /&gt;&lt;br /&gt;How does that compare with the rest of the province?&lt;br /&gt;&lt;br /&gt;Brantford's insolvency rate increased by a similar amount to Kitchener (36%), Toronto (39.9%)Windsor (39.5%) and fared much better than Hamilton (47.2%) and London (62.5%).&lt;br /&gt;&lt;br /&gt;The Ontario rate was up by 40.7%, so Brantford fared slightly better than the entire province.  In Canada consumer insolvencies increased by 35.9%, so Brantford was slightly worse than the national average.&lt;br /&gt;&lt;br /&gt;However, the statistics only tell part of the story.  In the last week I've met with a number of people in Brantford who are worried about losing their home, and they are worried about further job losses.  The numbers are bad now, and they worry they may get worse. Most of Harvey's clients are in the Brantford area, but he and his team helps people as far west as London, and as far east as Toronto.&lt;br /&gt;&lt;br /&gt;I wanted to meet with Mr. Woods (that's his picture on the right) to find out first hand how the credit crisis and the decline in the real estate market is impacting on residents of Brantford.  Specifically, is it still possible to refinance your house to repay your high interest credit card debts, and is it still possible to get a mortgage to buy a new home?&lt;br /&gt;&lt;br /&gt;Harvey told me that yes, it is still possible to get a mortgage, but it is more difficult to qualify than it was two year ago at the height of the real estate and credit market.  Two years ago it was common to be able to get a mortgage with no money down; today, it is almost impossible to get a no-money-down mortgage unless you have perfect credit and a high income.  If you have good credit and sufficient equity in your home, you may still be able to refinance up to 90% of your home's appraised value. I was told the food was great but the owner is a bit unusual.  Sure enough, the food was great, but when the waiter made a small mistake on Terri's order, the owner, rather than apologizing, came out an basically said "you have no choice but to sit and wait until we fix it."  Maybe it's just me, but perhaps an apology and a free appetizer might have been a better approach).&lt;br /&gt;&lt;br /&gt;The &lt;span style="font-weight: bold;"&gt;Family Counselling Centre of Brant&lt;/span&gt; is the only &lt;a href="http://www.bankruptcy-brantford.com/credit-counselling.htm"&gt;not-for-profit credit counselling agency that personally meets with clients in Brantford&lt;/a&gt;. Over the past few weeks, I have been hearing a number of stories that lead me to believe that the economy is really slowing down in Brantford.  We are in a recession in Brantford.&lt;br /&gt;&lt;br /&gt;I spoke to a car salesman at one of the local new car dealerships.  He told me that he sold half as many cars last month as he did in the same month last year.  I met with another person who told me that his factory has now gone to a work share arrangement, so instead of getting five days per week of work, he only gets two or three days per week, with a partial top up from unemployment insurance for the rest.&lt;br /&gt;&lt;br /&gt;Lots of other Brantford residents have told me that they are having a hard time finding a job, and those with a job have had their hours cut back at work.&lt;br /&gt;&lt;br /&gt;I have also heard lots of stories about house prices in Brantford.  One person this week told me that last year their house in Brantford was appraised at $195,000, but a recent appraisal for mortgage purposes put the value at $175,000.  This means it is now harder for people in Brantford to re-finance their mortgage if they need to raise extra money to deal with their debts.  And, of course, it is now harder to sell your house to get enough money to pay off all of your debts.&lt;br /&gt;&lt;br /&gt;The good news is that there is still hope. What is surprising to everyone is that it is rare for me to meet with someone who lost a lot of money gambling at the casino in Brantford. (If you are not working you have no wages for creditors to garnishee, so most people wait until they return to work to go bankrupt).&lt;br /&gt;&lt;br /&gt;The strike at the casino has caused problems for many of the employees at the casino.  I met with one person who was going to go bankrupt, but has delayed the filing until the strike is over. Many large employers often hold “lunch and learn” sessions where guest speakers discuss topical issues. Even if we are not experiencing financial problems ourselves, we often know others who have money problems, so I was asked to discuss strategies for dealing with debt problems.&lt;br /&gt;&lt;br /&gt;I started by describing the typical person I help here in Brantford. I explained that often bad things happen to good people, and as a result of job loss, marriage break up, medical condition, or bad money management people use credit to survive and end up with more debt than they can handle.&lt;br /&gt;&lt;br /&gt;We then talked about solutions to debt problems, including &lt;a href="http://www.moneyproblems.ca/household-budgeting.htm"&gt;personal budgeting&lt;/a&gt;, &lt;a href="http://www.debt-consolidation-loans-information.com/"&gt;debt consolidation&lt;/a&gt;, &lt;a href="http://www.bankruptcy-brantford.com/credit-counselling.htm"&gt;credit counselling&lt;/a&gt;, &lt;a href="http://www.bankruptcy-brantford.com/proposals.htm"&gt;consumer proposals&lt;/a&gt;, and &lt;a href="http://www.bankruptcy-brantford.com/bankruptcy-brantford.htm"&gt;bankruptcy&lt;/a&gt;.&lt;br /&gt;&lt;br /&gt;The group then had lots of questions about different ways to deal with debt, and they also had many questions about credit reports.&lt;br /&gt;&lt;br /&gt;Regarding credit reports, I recommended getting a free copy of your credit report each year to ensure that all information is correct. In total, 384 residents of Brantford went bankrupt in 2007.&lt;br /&gt;&lt;br /&gt;In addition, a further 112 Brantford, Ontario residents filed a &lt;a href="http://www.bankruptcy-brantford.com/proposals.htm"&gt;consumer proposal&lt;/a&gt; in 2007, a 12% increase from the 100 people in Brantford who filed a consumer proposal in 2006.&lt;br /&gt;&lt;br /&gt;While the unemployment rate declined slightly in 2007 in Brantford, employment growth was a tepid 1%. Similar to other communities in Ontario, Brantford has lost higher paying manufacturing jobs and replaced these with lower paying service jobs. In early 2007, Genfast Manufacturing Company was just one company to close resulting in the loss of 210 jobs in Brantford. In August, Canadian Blue Bird closed affecting a further 130 manufacturing jobs. I was in Ottawa, appearing as an expert witness before the &lt;a href="http://www.parl.gc.ca/common/Committee_SenHome.asp?Language=E&amp;amp;Parl=39&amp;amp;Ses=2&amp;amp;comm_id=3"&gt;Senate Standing Committee on Banking, Trade and Commerce&lt;/a&gt; to provide testimony on the proposed new bankruptcy rules.&lt;br /&gt;&lt;br /&gt;Most of the witnesses that have appeared before the Committee were lawyers or lobbyists; no-one had appeared to give the average bankrupt's perspective. In my opening remarks I told the Senators that the average person who goes bankrupt in Brantford, or anywhere in Canada, is a real person who in many cases has lost their job, gone through a marriage break-up, suffered through an illness or other personal problem, and is left with an overwhelming amount of debt.&lt;br /&gt;&lt;/div&gt;&lt;br /&gt;&lt;div&gt;In other words, people who go bankrupt, in most cases, are honest but unfortunate people who need a fresh start. Michelle and her team can help people learn to budget, and they can negotiate payment arrangements with your creditors, called a debt management plan.&lt;br /&gt;&lt;br /&gt;She e-mailed me today to remind me that today is the launch of the first annual Credit Education Week, which runs from November 13 to November 16. During the launch, the results of a national consumer survey of more than 4,000 Canadians were released, and the survey showed that the majority of Canadians do not have a sufficient understanding of basic personal finance and credit.&lt;br /&gt;&lt;br /&gt;Michelle and I have discussed credit problems many times over the years, so neither one of us was surprised that the survey found that 92% of the survey respondents feel that Canadians have more debt than they did five years ago, however only 7% perceive that it makes sense to carry a larger amount of debt now as compared to 5 years ago. Does it make sense? Are you receiving clear answers to your bankruptcy questions? Do I seem interested in your situation, or am I more interested in speeding through the meeting? A &lt;a href="http://www.bankruptcy-brantford.com/proposals.htm"&gt;consumer proposal &lt;/a&gt;is an alternative to bankruptcy, where you make payments to your creditors over a period of time, usually for less than the full amount owing. This is a big issue in Brantford, because many of us need our cars to get to work (as we all know, there is no subway in Brantford).&lt;br /&gt;&lt;br /&gt;The answer depends on a few factors.&lt;br /&gt;&lt;br /&gt;First, if you live in Brantford, or anywhere else in Ontario, you are allowed to keep one motor vehicle worth up to $5,650 if you go bankrupt. So, if you are driving an old car, you may be able to keep it.&lt;br /&gt;&lt;br /&gt;However, if there is a lien on your car, or if you got a loan and pledged your car as security, whether or not you keep your car if you go bankrupt is up to the lender. The lender in most cases will allow you to keep the car, provided you continue to make all of your regular car payments.&lt;br /&gt;&lt;br /&gt;A word of caution: not all banks will allow you to keep your car. Most banks do, but there is one bank in particular that will automatically repossess your car if you go bankrupt, even if your payments are up to date. In 2006 341 people filed for personal bankruptcy, and a further 100 people filed a &lt;a href="http://www.bankruptcy-brantford.com/proposals.htm"&gt;consumer proposal&lt;/a&gt;.&lt;br /&gt;&lt;br /&gt;The decrease in the personal bankruptcy rate in 2006 was the largest annual decrease in the bankruptcy rate in &lt;strong&gt;Brantford&lt;/strong&gt; since the 8.4% drop recorded in 2002. Unfortunately in 2003 the bankruptcy rate increased by 17.9%, the largest increase in many years. Will we see an increase in the bankruptcy rate in 2007, like we saw in 2003?&lt;br /&gt;&lt;br /&gt;Probably not. As new employers move to Brantford the employment picture should remain positive, so I predict very little change in the personal bankruptcy rate in Brantford in 2007.&lt;br /&gt;&lt;br /&gt;Of course just because bankruptcies are down does not mean that people don’t get into trouble. If you are in financial difficulty, you are not alone. In most cases I tell them that it is highly unlikely that anyone will take their furniture.&lt;br /&gt;&lt;br /&gt;In order to be able to seize your furniture the lender must have a lien on your furniture, or they must have a court order. If they don't, they can't take your furniture.&lt;br /&gt;&lt;br /&gt;Many finance companies give what are called household goods loans. As part of the loan documents they make you sign a document, with a list of your furniture, that gives them the right to repossess your furniture if you don't pay.
